Is it possible for a US citizen to marry a
b1/b2 visa holder in ny state if their
visa is legal and not yet expired?

Yes, but you want to be careful as to how many days have passed since his/her arrival. If you file too soon it appears as if they came solely for the purpose of marriage and that will not be looked upon favorably.
