Before filing anything with USCIS, you should review your file, including the application your sister sent and your "deportation letter" with an attorney. He/she will be able to advise you with respect to whether you are eligible to file a new application with USCIS based on your marriage to a US citizen.

You should definately have immigration lawyer review all of your documents before filing a petition. In general, even if a person is in deportation proceedings, s/he is may still be eligible to adjust the status based on a marriage to US Citizen. It might be more difficult and will possibly require longer process, possibly immigration court involvment and separate marriage interview.

If you need further help to guide you through the process, you can contact our firm.
