Legal Question in Immigration Law in New York

Hello,

I married my husband in July 2007 overseas. He had the first interview in Feb 2009 and was asked to come in for a 2nd interview in which I had to be present as well, Aug 2009. We both went and provided them with proofs that our marriage was valid. Since I lived here in NY and he lived in Ecuador we didnt have too many proofs because we were distant from each other and because of financial reasons and college I was only able to go see him 2 times a year. We got denied his green card. He decided to come here illegally (big mistake, but we felt we had no other option), and got caught in the border, was arrested and I bailed him out. This was in April 2010, now he has to go to court for that immigration arrest on Feb 2012 in which they will probably tell him he has to go back to Ecuador.

What can I do to prevent immigration from sending him back to ecuador, We have a live here, we honestly love each other. We have been married for almost 4 years now, we have a 4 month old baby that we adore and I would hate for her to be separated from her father.

Please let me know if there is anything I can do to prevent him from having to leave?

Thank you for your advice, i appreciate it.

Wife and Mother
