Divorce is independent of his deportation proceedings. If you want to divorce him, then go ahead and file for divorce (I'm assuming that in New York state, a spouse can file divorce for any reason or no reason at all).

Does your husband know that you want a divorce?
The reason I am asking is that if he agrees to sign the paperwork then you can also apply for an uncontested divorce.
