He may be able to adjust his status, depending on several factors (i.e has he been convicted of any crimes?). While I would need much more information, he may be able to apply for adjustment of status based upon his marriage to your daughter (if she is a US citizen). However, depending on how long ago his visa expired, he may also need to file additional waiver application if he has accrued something called "unlawful presence" in the United States.

Should you or your daughter wish to discuss this in further detail, feel free to contact our firm for a consultation. We routinely handle such cases. You can also look on our website (www.thakerlaw.com) for additional information that may be helpful!

Good luck!

If your daughter is a U.S. citizen, then he may have a chance to stop deportation and remain in USA, depending also on other factors, such as his prior criminal convictions, if any, etc.

You can contact our firm if need further information.
