Legal Question in Immigration Law in New York

Naturalization application

I've had a green card for 5 years

and I'm considering applying for

naturalization. The form asks you

to list and explain any arrests.

More than 10 years ago (when I was

here on a student visa) I was arrested

for a minor traffic violation

(outstanding speeding ticket), and

the charges ended up being dismissed.

Should I mention this incident in

my application given that it's from

so long ago and (seemingly) minor?

Because the question clearly asks whether you've been arrested under ANY circumstances, to be safe, you should check the "yes" box and indicate the outcome of the matter. This application does not make an exception for minor traffic violations.

You should disclose all arrests on form N-400. Many convictions will not affect your eligibility to naturalize. You should obtain all certificates of dispositions for any criminal charges from the criminal court. It is advisable to consult with a lawyer to review all convictions before applying for naturalization.
