Legal Question in Immigration Law in New York

Want to know my options

Hi, I wanted to go for the holidays back to my country but I just realize that my green card had expire on November. Now, I already got the I90 form but I would like to know if I could fly the way my card or status is now or if I send the form now, would I get some sort of permit in time so I could fly on December 22nd.

Re: Want to know my options

Was it a card valid for 10 years or just a two year card(conditional permanent residence and immigration based on marriage)? If it was a 10-year card, you just need to submit I-90 and obtain a temporary proof of your status (stamp in your valid passport or a special form with your photo on it)from your local USCIS office. This will be a proof of your permanent residence status. Also, if you were a permanent resident for 10 years, consider naturalization to avoid possible problems in future.

If it was a two-year card, instead of I-90 you and your spouse were supposed to file jointly form I-751 before the card expired. If this is the case, you may not travel abroad and need to consult an immigration attorney immediately.
