Legal Question in Immigration Law in New York

My passport was stolen which has my visa waiver inside, that shows when i entered the usa. i have overstayed for over two years and now want to get married. my question is how do i prove that i came here legally, i do not have my original plane tickets or boarding passes. i have reported my passport stolen to the british counsulate, which they have put a stop on it.

An application for replacement I-94W can be filed with the USCIS. This is important as it shows legal entry to the U.S., required for filing adjustment of status application within the U.S. based on marriage to a U.S. citizen.

You will need to file an I-102, Application for Replacement/Initial Nonimmigrant Arrival/Departure Document with USCIS. If they cannot find your I-94, you may be eligible for a waiver of inadmissibility but you may also have to adjust outside of the U.S., and will then face a bar since you overstayed your visa.
