Legal Question in Immigration Law in New York
permission to work while waiting for citizenship?
My friend was caught working illegally off the books (was arrested, is out on bail) while here on a student visa from Israel. He subsequently got married to a US citizen and is preparing to file and wait for the interview, etc. When will he legally be allowed to work? He believes because of his arrest he will not be allowed any kind of temporary work permit, and must wait until his case is totally completed, is this correct? What would he be expected to live on for the six months to a year or more that this might take?? This seems like an absurd catch-22 and its a terrible waste because he is a skilled college graduate! Is there a way for him to get a job legally in his field (teaching physical education to children) while he waits for his marriage to be reviewed?

He can file I-765 concurrently with his green card application package. Do not work illegally until he receives I-765 approval notice and gets his EAD card.
