Legal Question in Immigration Law in New York

I am planning on getting married to my boyfriend who is an illegal immigrant but I am also planning on joining the millitary next year. Will marriage to him affect my chances of getting into the millitary? Is it a good idea to get married to him now or wait until after I join the millitary?

Whether or not you can get into the military after marrying an illegal immigrant is not really a question relating to immigration law. You would have to look into the military enlistment standards.

However, if a US citizen marries an illegal immigrant who entered the US legally, the illegal immigrant can adjust status (if everything else is alright) and become a legal permanent resident. In most cases, adjustment of status takes 6-9 months (without any unexpected delays). In other words, your spouse may become a legal permanent resident by the time you join the military.

However, what I can say is that you should marry him when you are ready to commit and then file the petition.

Once you are married and in the military your husband will benefit from all the rights of a military spouse.
