Legal Question in Immigration Law in New York

pregnant temporary worker

hi, i'm currently working in the usa, i have h2b status. I happened to be pregnant. i have been in this country over 4 years. all the time legally. i would love to stay here. i know my baby would be born as an american citizen. i wonder is there any way for me to stay here based on the baby being born in the country, would i be able to apply for some waiver or something to get permision to stay, work, travel. is there a chance i can be deported and my baby would be kept in the usa as an american citizen? thank you for attention for this matter. sincerely

You may have various possibilities to stay in this country but your child petitioning for you is not one of them for now.

Re: pregnant temporary worker

A US Citizen cannot petition legal permanent residence for a parent until their 21st birthday.

This is designed to prevent a temporary alien from circumventing immigration laws by having children in US soil.
