Legal Question in Immigration Law in New York

Re-entry to usa

one of my relative is an immigrant through family visa. When he arrived in usa, the immigration stamped on his pasport as temporary resident and told him that his permanent green card would be mailed in three months. In the mean time he recieved a phone call from bangladesh that his mother was in dieing condition and he left usa with stamped passport but without greencard. Now he wants to come back to USA but his endorsement on his passport as temporary green card has expired on March 31st, 2007.

What procedure he will have to follow and how he will return to USA

Please let me know.

Your relative should consult with a U.S. immigration attorney. Apart from the issue of travelling with an expired I-551 stamp, there is potentially a bigger issue here, namely abandonment of permanent resident status, especially if the alien in question spent close to a year overseas. The circumstances of the trip abroad and those relating to the establishment of permanent residency in the U.S. need to be closely examined before advising your relative how to proceed.
