Legal Question in Immigration Law in New York
Removal because of a criminal act
This person was arrtested, served his time, and probation and now they wnat to remove him because of his criminal act, which was depositing fraudulent checks into a bank. It totaled under $8000. Is there a defense to this because it was under a certain amount, to keep him here?

It is not so much a defense but a relief that will enable him continue to remain in the US and avoid deportation.
If this is his only offense he can avoid deportation.
If the offense involved more than $10,000 then it is a REAL problem.
