Legal Question in Immigration Law in New York

Residency status

My wife and I are both citizens of Trinidad and Tobago. My wife has a teachers international visa. With this visa she is allowed to file for residency for me and her children. The paperwork has been submitted and we are awaiting responses. I currently have a H4 visa which expires June 2008. We have been married 4 years, have been living in the US for those 4 years and are currently seperated. If she decides that she does not want to continue with the process of filing for me due to our separation what are my options? I have established a life in the US and do not wish to return to Trinidad for an undetermined amount of time.

Re: Residency status

There are limited exceptions upon which you can continue to file for your residency without your spouse. You should consult an immigration attorney to see if you would fall within these exceptions. You are also welcome to contact me, my office contact information is below.
