Legal Question in Immigration Law in New York

I have been trying to sponsor my spouse and children to US. I hold non imigrant visa since December 2005. I arrived US in a DV visa program but left my wife and kids behind.
My question is, which form (I-130 or I-824) should I use to sponsor them now?

You cannot sponsor anyone until you complete the DV process and become a lawful permanent resident. If you entered on an immigrant visa, did you receive your "green card" yet ? Or if you arrived on a non-immigrant visa, did you file for adjustment of status ? Consult an immigration attorney who would need to review your entire immigration history to determine whether you can petition for your wife and children.
