Legal Question in Immigration Law in New York

I want to sponsor my wife. We are both in school and I am not working. My mother is willing to be a joint sponsor. Can I still sponsor my wife although I have no income? Also, do I need to reside with my mother if I am using her income?

Hi,

You can sponsor your wife without any problem. As the petitioner, you are required to file affidavit of support to show bona fide marriage. However, your mother can independently file affidavit of support, and if your mother earns an annual salary of, say, $22K or more, it is likely that she has sufficient income to support you wife.
