Legal Question in Immigration Law in New York

I want to start a consulting company and hire people on h 1 visa but I heard that consultant companies can not hire people on visa is this true? I heard it might be possible to hire on an h 1 visa if the consultant company already has a job to place the worker in with a detailed discription of the job the worker will be on. Which one is correct and how much will it cost to do this program?

Hi,

The petitioner can be a new company, but as long as it is capable of paying the offered salary, the H1B petition can be approved. In consulting cases, it is very important to provide an itinerary indicating where the beneficiary will be assigned and on the nature of the project. Presumably if the H1B beneficiary will be working at a client site, the H1B petitioner will bill the client at a higher rate than the salary being offered to the H1B beneficiary.
