Legal Question in Immigration Law in New York

I am a student from India, and had gone out of status in month of february and have been out of status for 7 months. My international school advisor has advised me to travel & reenter USA with the new I 20 . I need to know can I reenter on my existing F1 visa or it becomes void after me going out of status . My visa expires in 2011.Please give me your expert advise.

I would need more information regarding your particular case before I can comment on it properly.

However, what I can say is that once you have gone out of status the immigration service will be made aware of this.

Once you stop attending your classes the college MUST inform the immigration service that you are not taking your classes.

Should you leave now you will find that the passport control officer at the border will ask you some questions regarding your college.

As for re-entering the country again I must tell you the truth you could have a problem if the immigration service were informed that you went out of status.

As for your visa. please keep in mind that it does not matter that you have a visa and it has not expired. What matters is the decision that is made by the border officer.
