Legal Question in Immigration Law in New York

i am student in NY and i want to marry a person from india . can i bring him to NY and if yes then what will be his status and how can we be greencard.Also please let me know the chances of his visa after getting marry to me.

That depends on your status - you did not mention if you are a U.S. Citizen or not.

If you are a citizen, then you can marry your fiance and petition for his green card or you can apply for fiance visa, and then he can enter and apply for greenc ard here in USA.

If you have entered the US as a student on a F1 visa then you are not an immigrant.

The US immigration service expects you to leave the country within ten (10) days after your course ends.

I do not understand why you would be considering bringing someone else into the country when you are not a permanent resident or a citizen.

As for his status, if you marry him then he will have to apply for a visa just like you did and provide all the documents you did before you were given your visa. If he gets the visa and comes to the US he will not be permitted to work so how are you both going to support yourselves?

I cannot say what his chances would be to obtain a visa because it will depend on the information and documents he will provide to the US consulate in his country.

You didn�t reveal what is your immigration status, if you are F1 non immigrant then upon marriage your spouse could be qualified for F2 visa as a dependant. Your spouse chance of getting a visa depends on evidence that should be presented at consulate.
