Legal Question in Immigration Law in New York
Student Visa
I want to send my son to US for studies, he is 12 years old - his aunt can be appointed as a Guardian. Can he legally stay in US and study in school?

Re: Student Visa
The age of your son may be an issue in obtaining a student (F-1) visa to come study in the U.S. The F-1 visa is a nonimmigrant visa for international students who are qualified to attend a full course of study at colleges, universities, conservatories, academic high schools (subject to strict regulations) and institutions with language-training programs in the U.S. Although there is no minimum age to apply for an F-1 visa, the school your son wants to go to has to fit within the above profile and may impose its own minimum age or other requirements for students. If you can find an accredited American institution that would accept and enroll your son in accordance with the F1 visa conditions, then your son may be able to obtain the student visa and stay in the U.S. for the duration of the educational program.
