Legal Question in Immigration Law in New York

Tax forms

My question is about tax-forms. I overstayed my B1 visa for 2.5 years. Recently got married to American citizen but He doesnt have proper tax forms. Does that have any influence on the process of adjustment of my satus.

Thank you for your time

I really do appreciate.

Re: Tax forms

It all depends on what you mean by "he does not have proper tax forms."

If what you are implying means that he does not earn enough money for the I-864 Affidavit of Support to meet the Minimum Poverty Guidelines requirement for your family size, then he can always get a co-sponsor to execute a Joint Co-Sponsor Affidavit of Support to supplement any income deficit.

However, if what you are implying means he either failed to file, or improperly filed, his income taxes, you really should consult with a taxation expert before you move forward with your immigration marriage case.

Good luck.
