Legal Question in Immigration Law in New York

unemployed USC married with illegal immigrant. He was in the military for 5-6 years. Can he petition for his spouse? He is receiving 2700$ every month from the US treasury. will that be considered as his income? his spouse entered the US as a visitor visa and have been over stay.

Yes that will be considered to be his income. As long as the spouse has the stamp in her passport/I-94 card to show she was admitted/inspected into the U.S. then her husband can petition for her green card.
