Legal Question in Immigration Law in New York

unemployment

My husband is in the process of ''adjusting my status'', unfortunately, he just lost his job recently but my uncle on the other hand is co-sponsoring me. My question is, will it be a problem if my husband collects unemployment? Please help me...hope to hear from anyone ASAP!

Re: unemployment

The affidavit of support form I-765 requires your sponsor to satisfy certain income and/or asset requirements. Generally it is done by attaching copies of tax returns, W-2s and employer's letter confirming current employment. Between your spouse and your uncle co-sponsoring you, you should be able to satisfy the requirements of I-765 and qualify for adjustment of status, if they can document their income and assets convincingly. Contact an immigration attorney with specific questions.
