Legal Question in Immigration Law in New York

I'm a Venezuela citizen, I have been here for 3 three years studying a MBA, I'm in a OPT status in this moment up to October of this year. I'm engage with an American citizen, and we plan to get marriage next week. After our marriage my fiance is going to sponsor me to get my US resident. On the other hand my fiance is going to file his company on banckruptcy maybe next week too.

My question is: His banckruptcy's file affect in any way my sponsorship process? since his company is going to be in banckruptcy which option would be better for my resident's sponsorship, sponsr me as a fiance or as a wife?

Hi,

If you are going to be married, and if you plan to continue to remain in the U.S., all sponsorship paperwork should be filed on the basis of marriage.

An affidavit of support can be filed by someone else who is a U.S. citizen or permanent resident in addition to your husband. Therefore, there is no problem if your husband declares bankruptcy.
