Legal Question in Immigration Law in New York
We have been waiting three years for my wife's green card
I filed for my wife in Sept 2005, and
we have two interviews since then.
The last interviewer said he would
send us a letter asking for a photo
album and other documents but that
was a year ago and we have not
received any further contact from
USCIS. Our case is at the National
Benefits Center. How much longer
can the backlog last and is there any
way to find out what is keeping them
from making a decision?

You will have to provide me with more information about your case; however, litigation over unreasonable delayed adjustment of status cases is a good remedy.
For additional questions feel free to contact me directly.

Further details are necessary, but it seems that it's been a bit too long, and may be more agressive course of action needs to be taken to move your case along. You should consider hiring an attorney.

From your post, that seems like a long time and that you will need to follow-up with the office where you went for your interviews. If you did not go with an attorney, I strongly recommend that you seek attorney assistance now since there may be other issues with your case. Also, if you and your wife have moved since filing, you must notify USCIS.
Please do not hesitate to contact my office to discuss your wife's case and options in further detail.
