Legal Question in Immigration Law in New York

working visa

Hi! If I had a working Visa to come work and here and attend college. Now tht i have obtained my degree. My visa will expire at the end of this month. Can I re-apply for a working visa or do I have to apply for a student visa since I am going to pursue my masters in January. Or do I have to leave and come back.

Not knowing exactly what type of employment or student visa you are on now, I cannot answer your question, but generally you may be able to change status here in the U.S. from one non-immigrant visa to another without leaving, if the new visa is immediately available to you, you are admissible and otherwise qualify.

If you plan to travel outside the U.S., you will then need to obtain a new visa at a U.S. consulate abroad, though.

Finally, watch out for the date of expiration of your I-94 not to cause yourself to become out-of-status.
