Legal Question in Insurance Law in New York
Accident
I was in an accident a couple weeks ago; I was in the middle lane going through the intersection, the other guy came up on the right of me and sideswiped me. When the cops got there, I was still shaken up and when he asked me what happened, I started to say that it happened so fast, and he cut me off saying he didn't want to hear it. He went to the other driver and he told the cop that I didn't signal and turned right in front of him. That was a lie, I was going straight to make a left further up the road to where my work was located. If I was making a right, it would have taken me away from work. I tried to tell the cop this, but he told me he didn't want to hear it, that he found me at fault and if I wanted to dispute it, then go ahead. Now the other guy is saying he and 2 other people in the vehicle are injured. No one was hurt, and there originally was only 2 people in his car. Now a mystery person has appeared? First he said it was his mother and now he is saying it was his wife. My insurance company is saying that I need to have that cop ammend the accident report. How do I do this? And does any of this sound fishy??? I didn't even get to tell my side of the story!!!

You can go to the Precinct where the report was filed and try to file an amended or a supplemental Police report. In addition, you should fill out and file form MV-104 (standard NY Motor Vehicle form, you can get it online). Keep a copy of MV-104 for your records.
