Accident involving vehicle damage and minor personal injury
I would like to know if I can sue a person who pulled out in front of me for the loss in value of my vehicle. My vehicle will not be worth half as much on trade because it has been in an accident and I owe twice as much as it was worth on trade. I believe the other driver was given a ticket, I do know that he assumed full responsibility and his insurance company is paying for repairs and a rental car. The rental car is not like my car, therefore different to drive in the snow and ice we are getting this month. I also am being treated for whiplash like symptoms and stress related to the accident.

Regrettably, in NYS, loss of use of a vehicle is not recognized as a damage element ...although a court in Georgia has just last weekend that it is there. It seems we are a bit more archaic in NY.
