Legal Question in Insurance Law in New York

Auto insurance comparative law

I was driving 55 or so when a car pulled thru stop sign in front of me and I hit her car in back left side near bumper. Lady was ticketed for failure to yeild right of way. I talked to her ins. company and the adjuster said that because the road was wet she was going to put a % of blame on me. I told her she was crazy and I could not have stopped if it was dry. What % would the adjuster legally be able to take off my claim even when the police report states clearly that their client was at fault and ticketed? No lawyer will take this case because no severe injuries happened so I am on my own.

Re: Auto insurance comparative law

It is not a question of legally putting blame on you. If his offer is not satisfactory to you sue in small claims court. I would not agree to anything over 20% comparative fault.
