Legal Question in Insurance Law in New York

auto insurance on a rental car

I was invloved in two back to back auto accidents in NYS. Both times another vehicle hit me. While my car was being repaired a rental car was provided to me by the ins companies of the drivers who hit me. The rental agency had me sign a contract stating I would pay for the insurance. After I signed the contract I found out that my own ins company covered comprehensive ins while renting a car. The rental company still wants $270 from me for 27 days. Can I fight this?

Re: auto insurance on a rental car

No, you can't fight this. You agreed to pay the insurance. (You could have declined it, since your standard NY insurance policy covers rented passenger cars unless they are used in your business.) However, the $270 insurance charge is your "loss of use" claim, and should be added to your recovery from the other drivers' insurance. Speak to the adjusters and amend your claim.
