Legal Question in Insurance Law in New York

bad beat on the rental

we were in an accident on 8-12-06. We were struck from behind @ 80 mph and rolled over numerous times. The insurance for the driver who hit us has admitted fault and set us up in a rental for 5 days. Once that time was up, they extended the agreement for 3 more days until our adjustor returned from vacation. The ball was dropped somewhere and we were assured we would have a rental secured until the lein holder to our car was paid. However, we found out that the insurance company stopped payment on 9-5-06 and we are now responsible for the overdue balance. Our bank has yet to get payment for the car and our license plates are yet to be returned. The insurance company says we are out of luck. Yet several reps have told us, not to worry, we would be given ample time to secure a new car and to return the rental, with out any out of pocket charges. I spent 3 hours on the phone talking to the same 4 people who keep giving me the run around, telling us to talk to someone else. We cant afford to pay the $1,000 for the rental charges, as i am out of work because of injuries I sustained from the accident. We have been cursed at, hung up on and told not to call again. what are my options now?

Re: bad beat on the rental

Your option is to retain an attorney for all of the damages you sustained in this accident, which includes any out of pocket expenses, property damage, medical expenses, lost earnings and pain and suffering. An attorney may also be able to get results regarding the rental costs and payoff of your vehicle. Please feel free to contact me to discuss all of your options in more detail.
