Legal Question in Insurance Law in New York
car accident
Hi,I got in a car accident in NJ last week;my friend was drunk and driving to fast in the rain and lost control we spin and hit the divission of the expressway twice..the police came but didn't put me in the report and they didn't even check my friend for alcohol or anything and now I have severe pain in my head neck and back and I don't have insurance to go to a hospital.. Do I have a case to sue the insurance even if is not a full coverage insurance..what can I do.. Thank you

You should go and see a doctor right away. Your medical bills should be covered by your friend's auto insurance, under the no-fault provisions of his policy. If you already have a copy of the police report and you are not listed on it, call the Police Unit and the police officer who took down the report and find out how you can file a supplemental report. Further, I am not sure what you mean by "not full coverage insurance". Please feel free to e-mail me in private and I will be happy to discuss your case with you.

I'm not sure I understand this. You were a passenfer in a car accident. You were injured. The police came to the scene and made a report. You did not request a paramedic to look at you. You did not ask to be taken to the hospital. Your presence in the car is not reflected on the accident report.
You expect an insurance company to take your word for it that you were in the car and got hurt.
You are acting like you were born yesterday. I can assure you that neither I nor the insurance company adjusters were born yesterday. You will have a very hard time convincing an attorney to take your case, because it is barking.
