Re: Car accident
No but you may be able to sue. When was the accident? How extensive was your husband's treatment? If he sustained a serious injury you may have a good case. Check out my website www.kesslerlawyer.com and click on the automobile accident section. Thanks.
Re: Car accident
It does not appear that anything of a criminal nature occurred permitting you or your husband to press charges. However, depending on the severity of the injuries sustained, you and your husband may be able to pursue a claim and lawsuit to recover for those injuries, if they are "serious injuries" as defined by New York law. The immediate step to take is to apply for no-fault benefits with your insurance company. Then you should consult with an attorney regarding the possibility of pursuing a claim against the at-fault driver for the injuries sustained. I would be happy to speak with you further about this, as my firm handles motor vehicle accident cases on behalf of injured parties. Please feel free to contact me should you wish to discuss this further.
