Legal Question in Insurance Law in New York

Car Accident

In 2005, I was in a car accident. I was the passenger in the car and we were stopped at a red light. the car that hit us did not stop and was not given any tickets. I was previously disabled before the accident but my condition was made worse because of it. The laywer I had in the beginning had quit the case even though he did not do any work on it. My question is. What are my choices? What can I do to obtain a laywer again without me having to do all the work on the case?

You might have two cases. A lawyer is not allowed to simply dump a client once he or she accepts a case. What Messrs. Groezinger and Levinson, and Ms. Gendelman, have said is not incorrect, but I doubt that you will get far with the personal injury case.

The reason why I am doubtful about the injury case is (a) the driver of the car you were in does not appear to have done anything wrong and (b) the claim against the driver's uninsured motorist coverage and the claim against MVAIC might be gone with the wind. Both of these claims are subject to a much shorter time limit than the personal injury lawsuit. The first lawyer's failure to assert those claims would be malpractice (sue the bastard!) and would explain why he abandoned your case.

The bar authorities will help you get some justice, and they likely will suspend this attorney for stupidity. If you wish to do this (maybe wait until you see how helpful he is to the new attorney) click on http://www.nycourts.gov/ad4/ and go to the link for "attorney grievance."

In New York the statute of limitations for filing suit is 3 years, so you are still well within that time frame. You can retain another lawyyer to pursue this on your behalf. Feel free to contact me to discuss your options in more detail.
