Legal Question in Insurance Law in New York

Change in dollar amount of suit

I am in the middle of a civil trial. It is an automobile accident, where we are trying to determine who ran the red light. No witnesses- just myself and the the other driver(his mother was is his car and speaking as a witness.)

We are not doing well in court. In the middle of the trial-his lawyer put in a motion to increase the amount of damages they want.(He is claiming a ''back injury'') They went from a 1/2 million to 1 1/4 million dollars. Can he do this half way through the trial claiming future pain and suffering? The judge has not made a decision on this motion.
