Legal Question in Insurance Law in New York
Claim falsely denied
I am having a problem with my auto insurance.
The car was purchased, financed, insured, and driven away from lot on 11-3
On 11-7 it was in a accident.
The insurance says I did not have full coverage, even though I and the dealer have the binder from the broker.
Does it matter when the broker submits the binder and policy to the insurance company?
I can't believe it does, because that would mean if he delays a month, then car is not insured but being driven around. (Dealership and bank would never allow that since car is financed, not to mention its illegal)
Any advice on who is liable and how to force payment to get my car out of shop before its abandoned would be very helpful.

It depends on what the binder states and what the policy states. This is CRUCIAL. Without this, everything I can tell you is essentially meaningless.
