Legal Question in Insurance Law in New York

Damage Claim

While visiting a friend I over-cooked a bag of popcorn in the microwave oven. My friend filed a claim for smoke damage and now his insurance carrier is harassing me to pay the full amount. Sidestepping the inherent stupidity, isn't an invited guest the responsibility of the homeowner?

Re: Damage Claim

That's not quite true.

However, didn't your friend shamefully neglect to tell you it was a high-power oven? Did you file a claim for your own burned fingers when you tried to retrieve the smoking popcorn from his dangerous, defective, and trap-like microwave?

Look, your 'friend' is suing you through his insurance company. Go ahead and make a claim of your own. Certainly worth more than his smoke damage claim :-)
