For pity's sake, make sure you notify you own insurance carrier if you own a car or if you carry an excess policy, since that policy will back up the company's policy. It would not be the first time that a commercial carrier left an ex-employee swinging in the wind.
Re: Driving a company vehicle
Need more info! I am assuming you were still working for the company when you got into an accident. And further, that your company maintained the insurance for the vehicle. I am also assuming that the company is not suing you for indemnification and contribution, but that the allegedly injured driver of the other vehicle is now suing you and/or the company. You must absolutely make sure that the company has promptly notified its insurance carrier so that they assign a lawyer to defend you and the company and that insurance coverage will be available. If the accident was not promptly reported, the insurance company may seek to disclaim coverage on a theory that your company breached its insurance contract by not promptly reporting the incident.
Re: Driving a company vehicle
You should immediately get in touch with your former employer and find out if they notified their auto insurance carrier about this incident and whether they have assigned an attorney to defend you. BAsed upon your question, it also appears that you may not have been properly served with the summons and complaint. Feel free to contact me with any further questions.
