Legal Question in Insurance Law in New York
Employers required to provide COBRA insurance?
Six months ago my fiance terminated employment with a regional bank in NY. She was offered and accepted COBRA insurance. Every month since she has paid over 200 dollars, on time, to keep the insurance. She hasn't needed the insurance until recently when we became pregnant. However, the insurance company is refusing payment b/c she is not covered. We went back to the bank and they said they failed to sign her up to continue coverage. They have admitted negligence but still the bills aren't paid. Does my fiance have recourse against her former employer (the bank)? Thank you.

I received your message on 9-8-2000.
If the checks were cashed, called the COBRA-service compnay to inquire about why they accepted them. They can retro in your financee through the employer.
Good Luck.
