Legal Question in Insurance Law in New York

False Insurance Claim

Recently someone stole some items from my vehicle (I think I left it open). I was very upset and when filing an insurance claim I also said that some extra items were stolen. I feel very bad about this and want to cancel my claim, is there any way to do this without getting further in trouble? They have already mailed me my reimbursement check.

Re: False Insurance Claim

This once happened to my wife. She claimed on our insurance policy a diamond ring which she thought was stolen by a babysitter. Later on it was found. We had already used the check to buy a replacement ring. Now my wife had two rings, and I called up the insurance adjuster and told him that my wife had found the ring. I sent back a check for the money. He said that this had never happened to him before.

I would suggest that you contact the insurance company, return the reimbursement check, and only claim what was really lost. They will send you a replacement check. You don't even have to give them an explanation.

At least you will sleep at night.
