That would be the place where the final act necessary to "form" the contract took place. This is usually the home office of the insurer. But that's not the only consideration when the question is which state's law governs the policy. New York applies the "grouping of contacts" approach to conflicts of law, which means it searches for the State that has the most significant contacts with the policy and usually that turns out to be the locus of the risk. If the risks are multi-located, such as a policy that covers property in multiple states, the governing law is the domicil of the insured at the time the policy is issued.
