My tree near the house was struck by lightning. it detroyed property and the subsequent energy surge blew out some electronic equipment. The tree still stands, but it has a hole, crack in the trunk structure that expert arborist deemed it a hazard and strongly suggest it be taken down immediately. My insurance company will not pay for the tree as it did ''not fall'' .
Is this a legal stance the have?

There is a very good chance that your insurance company may very well be liable to reimburse you for your property damage despite the fact that the tree did not actually fall.
