Legal Question in Insurance Law in New York

Insurance doesn�t want to pay for vandalized car

Currently I have my insurance policy with Geico. In the middle of January my car was vandalized. Car was towed to the repair shop. Geico sent his adjuster to that shop and he did estimate for the damage. After that I�m trying to get some answer from Geico. They did one interview with me and my wife and that was all. All my calls to them didn�t give any result. About two weeks ago I called the again, and the said that they decline my claim, when I asked why they were not able to answer my question and said that they will send me a letter with explanation why they think my car is not covered. I called several times after that they keep telling me that letter will be send soon. If I�m leaving voice mails nobody returns me a call, if I�m trying to get name or phone number of the manager, they are not telling me. It�s almost four month that I�m without my car, and in meanwhile I still have to pay for my insurance policy. I need a suggestion what I can do in this case.

You must immediately send a letter to GEICO by certified mail, return receipt requested, putting at the top of the letter your policy number and the date of accident and, in the body of the letter, the same information that you placed in your inquiry on the Law Guru web site. You should then find the New York State Department of Insurance web site which will tell you where and how to file a complaint against GEICO

You can contact the New York State Department of Insurance. It's best to write them a letter making a complaint. Be sure to include your policy number and claim # if any. They will investigate your complaint against the insurance company. You may also wish to hire an attorney to handle the claim for you. An attorney can, if necessary and cost effective, commence a lawsuit against an insurance company.

Suggest you read your insurance policy as to next procedure to take. Arbitration or a lawsuit may be in order.
