Legal Question in Insurance Law in New York

Liability Insurance and coverage

I was rehearsing a dance piece and when doing a spin (slow) I heard something pop...fell to the ground..ended up needing surgery (arthroscopic) due to patella dislocated and cartelidge torn on both sides... and the studio has up to 5,000 dollars in liability insurance. Am I to get that much for part of the coverage (since the total amount of surgery and all is close to $10,000) or not? And how do I proceed in getting the money without problems?

Re: Liability Insurance and coverage

The popping was probably your ACL. But anyway...

...if it happened while at work, it's worker's compensation.

If your were not working, the liability medical pay coverage of the studio is when there is LIABILITY.

If nothing in the studio contributed to your fall, and the studio was not negligent, the med-pay portion does not cover.

Any other questions, please contact me.

Good Luck
