Legal Question in Insurance Law in New York
I live in ny, and my wife was rear ended while stopped for traffic. The girl that hit her admitted to being on her phone, she received a ticket for following too close. That girls insurance assumed 100% responsibility and is fixing my car, a 2008 honda accord. They however refuse to pay for the full price of the exhaust which was ruined because it has half of its life gone. As far as I know I am also out of luck for the reduced value of my car now that it will no longer have a clean car fax.
This doesn't sit right with me, nobody is looking out for the consumer, we didn't hit anybody, face possibly higher ins rates, or possible cancelation, reduced car value, and a bill for half of the exhaust. Is there ANYTHING I can do, I'm not a person that just sues everyone, but boy would I like to force them to pay for everything I feel they SHOULD.

You may bring an action in the small claims court of the county where the owner or driver of the vehicle resides.
