Legal Question in Insurance Law in New York

long term disability coverage

My doctor took me off work last March due to health reasons.My doctor and myself supplied all requested information at this time for short term disability.In Sept. of 1999 I started long term coverage.My case was handled by 2 or 3 different people between then and May of 2000.The first part of May I recieved a letter from them stating that they had determined that I was not eligible for long term due to pre-existing 2 months before I was eligible for long term on their policy and I would recieve no more payments and they expected a check for monies I did recieve in 30 days.Is this legal or is it something I can fight?I already submitted a request for an appeal.

Generally, you must first look to your insurance policies to ascertain what is excluded and what are the exceptions to the exclusions. Without more, it is difficult to provide an intelligent answer.
