Legal Question in Insurance Law in New York

Motorcycle accident

Two month ago I had a self motorcycle accident while I was driving my motorcycle in a special course for off roads motorcycle where you buy a ticket and you can use the course.

During the riding I lost control , got hurt and treated in a hospital for some broken arms and legs.

I do have a health Insurance (ppo care) but they denied the coverege for the treatment at the hospital as they claim that it is a ''challenge sport'' which it's exclude by the policy terms for coverege.

I was wearing a helmet and I know how to oparete an off road bike.

Do they have to pay for it since they are my primery insurer?

Re: Motorcycle accident

No-Fault does not apply to motor cycles.

Check your policy. They may be correct...but only your policy will state for certain. They may be correct.

Good Luck

Re: Motorcycle accident

The issue is what is the definition of a "challenge sport". Read your policy.
