Legal Question in Insurance Law in New York
single insurance policy on two residences rescinded due to Material Misrepresentation. policy was in effect for 5 years. Company returned all premiums for 5 years. company denying claim on house #2 but previously paid claim on house #1. question 1: does paying the first claim and closing it out prove that the company honored their policy? Question 2: If policy "never existed" is the homeowner responsible for repayment of the closed claim on house 1? State: New York
