Legal Question in Insurance Law in New York

Subrogation Claim

What is a subrogation claim and what is the purpose for an auto insurnace company to file one? I have never been involved an MVA, never been arrested for anything, never been investigated by police, or been involved in any other sort of overt behavior but have received this from an insurance company for something that happened in Dec 2002. I am not sure how to respond or rather not respond. Any information that can be provided would be greatly appreciated. Thank-you for your assistance.

Re: Subrogation Claim

You are being sued because someone else's insurance paid a claim that is believed to be your fault...now that insurance company wants it's money back that itpaid to its own policyholder.

Turn this lawsuit over to your own insurance company or broker for the time that was listed in the accident (not your current policy). If you let it go unanswered, a default judgment will be taken against you.

Good luck

Re: Subrogation Claim

The insurance company apparently paid off a claim by their insured. They then stand in their insureds shoes and may pursue a subrogation claim against the party who caused the loss. If you had insurance at the time that covered this loss contact your insurance carreir.
