Legal Question in Insurance Law in New York
Tree fell on van
One of my workers was parked on a public street, by a school. During a storm a dead tree fell and caused $4,500.00 in damages. He does not have collision coverage. Does the school have responsibility? If so, what course of action should he pursue. The district said that since no one had written to notify them of a dead tree, they are not responsible.

Re: Tree fell on van
That means that the school did not have notice of the dangerous condition. However, they may be lying. You should make a freedom of information request to the school district and ask for prior accident or incident records. You should also sue the school in district or small claims court. You may want to hire a lawyer as well since you are probably a corporation.
